Introduction

Welcome to EmeronBiz, the provider of NFC digital cards designed to enhance connectivity and streamline communication. These Terms and Conditions ("Terms") govern your access to and use of EmeronBiz's products and services, including any content, functionality, and features offered (referred to as the "Services"). By accessing or using EmeronBiz, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use EmeronBiz.

Definitions

In these Terms, the following words and phrases have the meanings set out below:

• "EmeronBiz" means the provider of NFC digital cards developed and provided by Emeron Infospace FZE.
• "Services" means the products and services provided by EmeronBiz.
• "User" means any individual or entity that uses EmeronBiz.
• "User Account" means the account created by a User to access and use EmeronBiz.
• "We", "us", "our" means Emeron Infospace FZE, the provider of EmeronBiz.

Eligibility

You must be at least 18 years old to use EmeronBiz. By using EmeronBiz, you represent and warrant that you are at least 18 years old.

User Account

To access certain features of EmeronBiz, you may need to create a User Account. You are responsible for maintaining the confidentiality of your User Account and password and for restricting access to your User Account. You agree to accept responsibility for all activities that occur under your User Account or password. You agree to notify us immediately of any unauthorised use of your User Account or password or any other breach of security. We reserve the right to terminate your User Account or restrict access to EmeronBiz if we believe that you have violated these Terms.

Use of EmeronBiz

You agree to use EmeronBiz only for lawful purposes and in accordance with these Terms. You agree not to use EmeronBiz in any way that violates any applicable law or regulation. Specifically, you agree not to:

• Use EmeronBiz to transmit any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, or any other form of solicitation.
• Use EmeronBiz to transmit any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• Use EmeronBiz to violate the privacy or rights of any person or entity.
• Use EmeronBiz to transmit any material that contains viruses, worms, Trojan horses, or any other harmful or malicious code.
• Use EmeronBiz in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party's use and enjoyment of the Services.
• Use any robot, spider, or other automatic device, process, or means to access EmeronBiz for any purpose, including monitoring or copying any of the material on EmeronBiz.

Intellectual Property Rights

EmeronBiz and its entire contents, features, and functionality are owned by Emeron Infospace FZE or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property or proprietary rights laws. You agree not to copy, modify, distribute, sell, or lease any part of EmeronBiz or any of its contents, features, or functionality, nor may you reverse engineer or attempt to extract the source code of EmeronBiz.

Disclaimer of Warranties

EmeronBiz is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not make any warranties or representations regarding the use of or the results of EmeronBiz in terms of its correctness, accuracy, reliability, or otherwise.

We do not warrant that EmeronBiz will be uninterrupted or error-free, that defects will be corrected, or that EmeronBiz or the server that makes it available are free of viruses or other harmful components.

Limitation of Liability

In no event shall Emeron Infospace FZE or its affiliates, agents, directors, employees, or licensors be liable to you or any other party for any indirect, special, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with EmeronBiz or these Terms, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Emeron Infospace FZE and its affiliates, agents, directors, employees, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of EmeronBiz or your breach of these Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Financial Centre-London Court of International Arbitration.
